These Terms constitute a legally binding agreement. We recommend reviewing them carefully. This document was last reviewed with reference to LFPDPPP 2025 (Mexico) and CCPA/CPRA (United States).
Terms of Service
1. Acceptance of Terms
By accessing or using ZendPaw ("the Service," "Platform"), you ("User," "Customer," "Subscriber") agree to be legally bound by these Terms of Service ("Terms"). If you are using ZendPaw on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree to these Terms, you must not access or use the Service.
These Terms apply to all users of ZendPaw, including visitors to www.zendpaw.com, waitlist registrants, beta participants, and paid subscribers.
2. Description of Service
ZendPaw is a cloud-based Software as a Service (SaaS) platform designed for pet service businesses including grooming salons, mobile groomers, veterinary clinics, and pet care providers. The platform provides tools for appointment scheduling, client and pet record management, staff management, automated reminders, payment processing, and related business operations.
ZendPaw is operated by CardoCore ("Company," "we," "us," "our"), based in the Yucatan Peninsula, Mexico, serving customers in Mexico, the United States, and internationally.
Subscription plans and their features are described on our Pricing page at www.zendpaw.com/pricing. We reserve the right to modify plan features with 30 days' notice to existing subscribers. Pricing is subject to change as described in Section 6.
3. Eligibility and Account Registration
3.1 Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use ZendPaw. By registering, you represent that you meet these requirements.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. Providing false or misleading information is grounds for immediate termination.
3.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at hello@zendpaw.com if you suspect unauthorized access to your account. ZendPaw is not liable for any loss or damage resulting from unauthorized access caused by your failure to protect your credentials.
3.4 One Account Per Business
Each business entity may maintain one active ZendPaw account. Creating multiple accounts to circumvent plan limits or restrictions is prohibited and may result in termination of all associated accounts.
4. Beta Program and Early Access
During ZendPaw's beta period, some or all features may be provided free of charge or at a discounted rate to early access participants ("Beta Users"). Beta features are provided AS IS and may be modified, discontinued, or changed without notice. Beta Users acknowledge that:
- (a) The platform may contain bugs, errors, or incomplete features
- (b) Data loss, though unlikely, is possible during beta
- (c) Beta pricing and benefits are not guaranteed to continue after the beta period ends
- (d) We may terminate beta access at any time without liability
- (e) Feedback provided during beta may be used to improve the platform without compensation
Early bird benefits (such as free months of service) granted during the waitlist or beta phase are subject to terms communicated at the time of the offer. These benefits apply to the subscription plan active at the time of conversion and are non-transferable.
5. License to Use the Service
5.1 Grant of License
Subject to these Terms and payment of applicable fees, ZendPaw grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business operations.
5.2 Restrictions
You may not:
- (a) Copy, modify, distribute, sell, or sublicense the Service or any part of it
- (b) Reverse engineer, decompile, or attempt to extract the source code of the Service
- (c) Use the Service to build a competing product or service
- (d) Frame or mirror any part of the Service without written permission
- (e) Use automated scripts, bots, or scrapers to access or interact with the Service
- (f) Remove or alter any proprietary notices, labels, or marks
6. Payment Terms and Billing
6.1 Subscription Fees
ZendPaw offers monthly subscription plans. Current pricing is available at www.zendpaw.com/pricing. All prices are listed in USD unless otherwise stated.
6.2 Billing Cycle
Subscriptions are billed monthly on the anniversary of your subscription start date. By subscribing, you authorize ZendPaw to charge your payment method automatically at the beginning of each billing cycle.
6.3 Automatic Renewal
SUBSCRIPTIONS AUTOMATICALLY RENEW EACH MONTH UNLESS CANCELLED. You may cancel at any time from your account Settings page. Cancellation takes effect at the end of the current billing period. You will retain access to the Service through the end of the paid period.
6.4 Price Changes
We may change subscription prices with 30 days' advance notice to your registered email address. Continued use of the Service after the effective date of a price change constitutes acceptance of the new price. If you do not accept the new price, you may cancel before the effective date.
6.5 Refund Policy
All subscription fees are non-refundable except where required by applicable law. If you cancel within 7 days of your initial subscription (not renewals), you may request a full refund by contacting hello@zendpaw.com. We evaluate refund requests on a case-by-case basis for exceptional circumstances.
6.6 Failed Payments
If a payment fails, we will notify you by email and attempt to charge your payment method again. If payment is not received within 7 days of the failed attempt, your account may be suspended. Accounts suspended for non-payment may be terminated after 30 days, and your data may be deleted in accordance with our data retention policy.
6.7 Taxes
You are responsible for all applicable taxes associated with your subscription. For Mexican users, applicable IVA (Impuesto al Valor Agregado) may be added to your subscription price as required by Mexican tax law. ZendPaw will issue digital invoices (CFDI) to Mexican subscribers upon request.
6.8 Payment Processor
Payments are processed by Stripe, Inc. By subscribing, you also agree to Stripe's Terms of Service available at stripe.com/legal. Your payment information is processed directly by Stripe and is not stored on ZendPaw's servers.
7. Acceptable Use Policy
You agree to use ZendPaw only for lawful purposes and in accordance with these Terms. You must not:
- (a) Use the Service to process, store, or transmit any content that is illegal, defamatory, obscene, or infringes any third-party rights
- (b) Use the Service to send unsolicited communications (spam) to your clients or any third parties
- (c) Use the Service to engage in any activity that violates applicable laws or regulations in your jurisdiction
- (d) Attempt to gain unauthorized access to any part of the Service, our servers, or any systems connected to the Service
- (e) Interfere with or disrupt the integrity or performance of the Service or the data contained therein
- (f) Upload or transmit viruses, malware, or any other malicious code
- (g) Use the Service to collect or process sensitive personal data (such as financial account numbers or government IDs) in ways not supported or intended by the platform
- (h) Impersonate any person or entity or misrepresent your affiliation with any person or entity
Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund, and may be reported to relevant authorities.
8. Your Data and Data Ownership
8.1 Your Data
"Your Data" means all data you upload, submit, or generate through your use of the Service, including client records, pet profiles, appointment data, and business information.
8.2 Ownership
You retain full ownership of Your Data. ZendPaw does not claim any intellectual property rights over Your Data.
8.3 License to Process Your Data
You grant ZendPaw a limited, non-exclusive license to access, process, store, and use Your Data solely as necessary to provide the Service to you, to comply with legal obligations, and to improve the Service using anonymized, aggregated data.
8.4 Data Accuracy
You are solely responsible for the accuracy, quality, and legality of Your Data, including ensuring you have the right to collect and process personal data belonging to your clients (such as their names, contact information, and pet health records) in compliance with applicable privacy laws in your jurisdiction.
8.5 Data Export and Portability
You may export Your Data at any time from your account settings. Upon cancellation, you have 30 days to export your data before it is deleted from our servers.
8.6 Data Deletion
Upon account termination, Your Data will be deleted from our active systems within 30 days and from backup systems within 90 days, unless retention is required by applicable law.
9. Data Protection and Privacy
9.1 Privacy Policy
Our collection and use of personal data is governed by our Privacy Policy at www.zendpaw.com/privacy, which is incorporated into these Terms by reference.
9.2 Data Processing - Mexico (LFPDPPP 2025)
ZendPaw acts as a data controller with respect to data collected directly from you, and as a data processor with respect to personal data you upload about your clients. By using ZendPaw, you, as the data controller for your clients' data, authorize ZendPaw to process that data as your data processor in accordance with these Terms.
You are responsible for ensuring that your collection and use of your clients' personal data complies with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP 2025) and its regulations, including obtaining any necessary consent from your clients.
To exercise ARCO rights (Access, Rectification, Cancellation, Opposition) regarding your own account data, contact: hello@zendpaw.com. We will respond within 20 business days as required by law.
9.3 Data Protection - United States (CCPA/CPRA)
For California residents and US subscribers: ZendPaw does not sell or share your personal information with third parties for their own marketing purposes. For data subject rights requests, contact hello@zendpaw.com.
9.4 Security
ZendPaw implements commercially reasonable technical and organizational measures to protect Your Data against unauthorized access, loss, or alteration. These include encrypted data transmission (HTTPS/TLS), hashed password storage, rate-limited authentication, and CAPTCHA-based bot protection. However, no system is completely secure, and we cannot guarantee absolute security.
9.5 Data Breach Notification
In the event of a confirmed data breach affecting your account data, we will notify you by email as soon as reasonably practicable and within the timeframes required by applicable law (72 hours under GDPR, promptly under LFPDPPP 2025).
10. Intellectual Property
10.1 ZendPaw Ownership
ZendPaw and all of its components - including but not limited to the software, code, design, user interface, text, graphics, logos, trademarks, and documentation - are the exclusive property of CardoCore and its licensors. All rights not expressly granted to you in these Terms are reserved.
10.2 Feedback
If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant ZendPaw an irrevocable, perpetual, royalty-free license to use, implement, and incorporate that Feedback into the Service without any obligation or compensation to you.
10.3 Your Trademarks
Nothing in these Terms grants ZendPaw the right to use your business name, logo, or trademarks without your prior written consent, except that we may list you as a customer in our marketing materials unless you opt out by emailing hello@zendpaw.com.
11. Third-Party Services and Integrations
ZendPaw integrates with third-party services including:
- Stripe (payment processing) - stripe.com/legal
- Cloudflare (security and bot protection) - cloudflare.com/privacypolicy
- Resend (transactional email delivery)
- Neon (database infrastructure)
Your use of these third-party services is subject to their respective terms and policies. ZendPaw is not responsible for the practices, availability, or conduct of third-party services. We select third-party providers who maintain industry-standard security practices, but we cannot guarantee their performance or compliance.
12. Service Availability and Support
12.1 Availability
ZendPaw aims to provide reliable service availability. We do not guarantee any specific uptime percentage during the beta period. Scheduled maintenance will be communicated in advance where reasonably practicable. Unplanned outages will be communicated via email and/or a status page.
12.2 Support
Customer support is available via email at hello@zendpaw.com. We aim to respond to support requests within 2 business days. Support is provided in Spanish and English.
12.3 Service Modifications
We reserve the right to modify, update, or discontinue any feature of the Service at any time with reasonable notice. We will not discontinue the entire Service without at least 30 days' notice to active subscribers.
13. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. ZendPaw does not warrant that:
- (a) The service will be uninterrupted, error-free, or secure
- (b) Any defects will be corrected
- (c) The service or its servers are free of viruses or harmful components
- (d) The results obtained from using the service will meet your requirements
14. Limitation of Liability
14.1 To the maximum extent permitted by applicable law, CardoCore and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of the Service.
14.2 In no event will our total liability to you for all claims arising from or related to these Terms or the Service exceed the greater of: (a) the amount you paid to ZendPaw in the 12 months preceding the claim, or (b) USD $100.
14.3 Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless CardoCore and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- (a) Your use of the Service in violation of these Terms
- (b) Your violation of any applicable law or regulation, including privacy laws applicable to your clients' data
- (c) Your Data, including any claim that Your Data infringes the rights of a third party
- (d) Any dispute between you and your clients arising from your use of ZendPaw
16. Termination
16.1 Termination by You
You may cancel your subscription at any time from your account Settings. Cancellation takes effect at the end of the current billing period. To request immediate account deletion, email hello@zendpaw.com.
16.2 Termination by ZendPaw
We may suspend or terminate your account immediately and without prior notice if:
- (a) You violate these Terms or our Acceptable Use Policy
- (b) We suspect fraudulent, abusive, or illegal activity
- (c) Required by law or a court order
- (d) Your payment remains overdue for more than 30 days
16.3 Effect of Termination
Upon termination: your license to use the Service ends immediately; you lose access to Your Data stored in the platform; you have 30 days to export data before deletion; outstanding fees remain due and payable.
17. Dispute Resolution
17.1 Informal Resolution
Before filing any formal claim, both parties agree to attempt to resolve disputes informally by contacting hello@zendpaw.com. We will attempt to resolve the matter within 30 days.
17.2 Governing Law
These Terms are governed by the laws of the State of Florida, United States of America, without regard to conflict of law principles, except that:
For users based in Mexico: disputes related to consumer protection or personal data rights are additionally subject to applicable Mexican federal law, including the Ley Federal de Proteccion al Consumidor (PROFECO) and the LFPDPPP 2025. Mexican users may also file complaints with the Secretaria Anticorrupcion y Buen Gobierno for data protection matters.
17.3 Jurisdiction
You agree that any formal legal proceedings will be brought exclusively in the courts of the State of Florida, USA, and you consent to the personal jurisdiction of those courts, except where mandatory local consumer protection laws in your jurisdiction provide otherwise.
17.4 Class Action Waiver
To the extent permitted by law, all claims must be brought in an individual capacity and not as a plaintiff or class member in any class action, collective, or representative proceeding.
18. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will:
- (a) Update the "Last Updated" date at the top of this page
- (b) Send an email notification to your registered email address at least 14 days before the changes take effect
- (c) Display a notice in your account dashboard
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the changes, you must cancel your subscription before the effective date.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and ZendPaw regarding the Service and supersede all prior agreements or understandings.
19.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
19.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
19.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets.
19.5 Force Majeure
ZendPaw will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party service failures.
19.6 Language
These Terms are written in English. For Mexican users, a Spanish translation is provided for reference. In case of any conflict or ambiguity, the English version prevails.
